Intellectual property, innovation and new space technology

Abstract

In 1992 Sam Ricketson published ‘New Wine into Old Bottles: Technological Change and Intellectual Property Rights’, considering ‘the effect that rapid technological change is having on the traditional formulations of intellectual property rights’. Technological change has continued to advance at a rapid pace, and the disruptions caused by information technology and the internet have now moved into the space industry. This chapter considers some of the challenges posed by the New Space industry, including the interaction of intellectual property with national security concerns, export controls and international law relating to co-operation in space.
