| Abstract: | The article presents an analysis of the case of Adela Pankhurst, a pacifist in Australia who was jailed in November 1917 for her beliefs, to emphasize the importance of the rule of law. It cites E. P. Thompson's study of the Black Act, a legislation passed in 1723 to address concerns about poaching but which later used as tool for repression, as an excellent analysis of the operation of the rule of law. It discusses the facts of the Pankhurst case and how the ruling in the case serves to highlight the importance of the rule of law in protecting liberty. |
